1. Acceptance, scope and eligibility
These terms form an agreement between you and YESI Pty Ltd (ABN 57 637 465 626), trading as YESI Education (“YESI”, “we”, “us” or “our”). They apply when you access or use our websites, applications, courses, books, audio, newsletters, tools and other content.
By using a YESI product, you agree to these terms and our Privacy Policy. If you use a product for an organisation, you confirm that you can bind that organisation. You must be at least 13, and if you are under 18 your parent or guardian must review and accept these terms where required.
For Apple-distributed applications, this agreement is between you and YESI—not Apple. Apple is a third-party beneficiary and may enforce applicable licence terms.
2. Licence and acceptable use
Subject to these terms, YESI grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access the relevant product and its content for lawful, non-commercial educational use. Apple applications may be used on Apple-branded devices you own or control in accordance with Apple’s Usage Rules.
You must not:
- Copy, resell, redistribute or create unauthorised derivative works.
- Reverse engineer, decompile or circumvent technical protections.
- Scrape content or use automated tools to extract our materials.
- Use a product unlawfully, fraudulently or to harm others.
- Interfere with our systems or attempt unauthorised access.
- Share single-user credentials or subscription access.
- Use YESI content to build a competing product without permission.
We may investigate misuse, restrict access and report unlawful activity where appropriate.
3. User accounts
Where an account is offered, you must provide accurate information, keep it current, protect your credentials and take responsibility for activity under your account. Notify us promptly if you suspect unauthorised use. Accounts are personal and may not be shared.
4. Subscriptions and Apple In-App Purchases
Some applications offer premium access through auto-renewable weekly, monthly or annual subscriptions. Available plans, local prices, billing periods and included features are shown before purchase. Prices may vary by country and may change for future renewal periods with notice provided by Apple where required.
Apple processes all App Store payments and acts as merchant of record. YESI does not receive payment-card details and cannot directly charge, cancel or refund an Apple purchase. Access remains conditional on a valid entitlement and compliance with these terms.
Automatic renewal
Unless cancelled at least 24 hours before the current period ends, a subscription renews for the same duration. Your Apple ID is charged within 24 hours before renewal. Cancellation stops future renewal; access generally continues until the paid period ends.
5. Free trials, cancellation and refunds
A disclosed free trial automatically converts to a paid subscription unless cancelled at least 24 hours before it ends. Trial availability may be limited to new subscribers. Purchasing a subscription during a trial forfeits the unused trial period.
Cancel through Settings → your name → Subscriptions on an Apple device. Deleting an app does not cancel its subscription. Purchases are subject to Apple’s refund policy; requests should be made at reportaproblem.apple.com. Nothing in this section limits non-excludable consumer rights.
6. Intellectual property and user content
YESI and its licensors retain all rights in our products, software, courses, books, audio, graphics, trademarks and other content. No ownership transfers to you. Copyright © 2026 YESI Pty Ltd. All rights reserved.
If a product accepts user content, you remain responsible for it and confirm you have the rights needed to submit it. You grant YESI a non-exclusive, worldwide, royalty-free licence to host, reproduce and use that content as needed to operate and improve the service. We may remove unlawful, infringing, abusive or spam content.
Feedback and suggestions may be used by YESI without restriction or compensation. Copyright concerns should be sent to y021@pm.me with enough information to identify the work and alleged infringement.
7. Privacy and third-party services
Our Privacy Policy explains how we handle personal information and is incorporated into these terms. Products may link to or integrate third-party services, including Apple, analytics providers and external learning platforms. Their own terms and policies apply, and YESI is not responsible for services it does not control.
Apple is not responsible for maintaining or supporting our apps. YESI, not Apple, is responsible for product claims and applicable consumer, privacy or intellectual-property matters relating to a YESI app.
8. Disclaimers, liability and indemnification
To the maximum extent permitted by law, products and content are provided “as is” and “as available”. We do not guarantee uninterrupted access, error-free operation, completeness, particular learning outcomes or fitness for a specific purpose. Educational content is general information, not legal, financial, medical or other professional advice.
To the maximum extent permitted by law, YESI is not liable for indirect, incidental, special, consequential, exemplary or punitive loss. Our aggregate liability relating to a product is limited to the greater of amounts you paid for that product in the preceding twelve months or AUD $100. These limits do not apply where they cannot lawfully operate.
You agree to indemnify YESI against claims and reasonable costs caused by your unlawful use, breach of these terms, infringement of another person’s rights or content you submit, to the extent permitted by law.
9. Suspension and termination
We may suspend or terminate access for breach, abuse, security risk, non-payment or conduct harmful to users, third parties or YESI. You may end this agreement by ceasing use and deleting the product. Deleting an app does not cancel an Apple subscription; cancellation must be completed separately through Apple.
10. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major service failure, you may cancel and receive a refund for the unused portion or compensation for reduced value, and may be entitled to compensation for reasonably foreseeable loss. For a non-major failure, you may require the issue to be remedied within a reasonable time.
Nothing in these terms excludes, restricts or modifies a statutory guarantee, right or remedy that cannot legally be excluded.
11. Governing law and dispute resolution
These terms are governed by the laws of New South Wales, Australia. Before formal proceedings, contact us and allow 30 days for a good-faith attempt to resolve the dispute. Unresolved disputes may be referred to mediation through the Australian Disputes Centre before court proceedings. You submit to the non-exclusive jurisdiction of the courts of New South Wales and competent appeal courts.
12. Changes, severability and contact
We may update these terms by changing the effective date and providing additional notice where required. Continued use after the effective date means you accept the revised terms. If any provision is invalid, the remaining provisions continue. These terms and incorporated policies form the entire agreement about their subject matter.
